Bill to allow for Tracker Mortgage collective lawsuits set for Dáil support this week – Donnchadh Ó Laoghaire TD

The Dáil will this evening debate a Sinn Féin Bill proposed by Justice spokesperson Donnchadh Ó Laoghaire which allows collective lawsuits to be taken in instances of wrongdoing, and would be of particular benefit to those who fell victim to the latest Tracker Mortgage scandal.

The Bill will be discussed at 8pm this evening and will be voted on by all Deputies in the Dáil this coming Thursday.

It provides for a Procedure where groups of persons have been affected by an issue of a similar issue of fact or law, to take the action together.

Commenting on the Bill Deputy Ó Laoghaire said;

“From speaking to other Deputies over the weekend I’m encouraged by their take on this legislation, and I believe the Bill will pass with the support of Fianna Fáil when voted on this coming Thursday. That would be a significant statement by the Dáil.

“This legislation will revolutionise the way that our courts handle cases such as the Tracker Mortgage scandal, and could give countless numbers of people greater access to Justice. I believe that we will have taken a significant step towards a fairer, more equitable Justice system if we pass this Bill.

“This legislation is a potential game changer in how the courts deal with cases where large categories of people are affected by a particular injustice or inequity, and share a common issue of fact or law; and has a very wide potential application.

“We are far behind comparable jurisdictions in not having an avenue to justice like this.

“It would have a similar effect and impact as processes such as the Class Action in the United States, or the Group Legal Order in Britain.

“There are many people out there, who are the victims of injustices, and who would have an actionable case, but the cost of taking it on themselves makes it effectively impossible.

“This bill brings access to justice within their grasp.”
