Human Rights Commissioner should call for European ruling on 42 day detention - Anderson

8 July, 2008 - by Maeve McLaughlin

Sinn Féin Human Rights Spokesperson, Martina Anderson has welcomed the comments by the Human Rights Commissioner, Monica McWilliams on the 42 Day Detention Bill which is before the British House of Lords today.

Ms Anderson said:

"I welcome the comments today by Human Rights Commissioner, Monica McWilliams, pointing out the incompatibility of this draconian legislation with Article 5 of the European Convention on Human Rights.

"Monica McWilliams is equally critical of the British governments attempts to introduce changes to the Inquest system which would allow the holding of inquests without a jury and in secret if the British Secretary of State so decided.

"I could not agree more with the sentiment of the Commissioners comments. But sentiments and criticism is not enough. On behalf of the people of the North of Ireland and for the wider good and protection of Human Rights I would urge the Commissioner to seek a European ruling on the legality of this legislation.
