Judgement of Spanish Constitutional Court an important ‘first step’

28 May, 2009 - by Martina Anderson MEP

Bairbre de Brún MEP welcomed the decision of the Constitutional Court in Spain to overturn the Supreme Court decision earlier this week to ban the electoral list Iniciativa Internacional-Solidaridad entre los Pueblos (Solidarity between peoples - II-SP) from contesting the elections to the European Parliament.

She said:

“The solidarity between peoples list, headed by the world renowned playwright Alfredo Sastre, has an important contribution to make to the debate on the future of the EU, and to the issue of human rights and democracy within the EU and around the world.

“The Constitutional Court has taken a first important step in reasserting its integrity and its independence of the government of the day.

“We are deeply concerned that the legislation remains in place to ban political parties, and that this law has been used extensively to ban a range of cultural and youth organisations, as well as political parties supportive of Basque independence.

"Sinn Féin supports efforts within the Basque Country to establish a peace process on the basis of equality, not criminalisation and exclusion.

“While the decision of the Constitutional Court does not overturn previous bans, it must give hope that they will be examined and a more rational and democratic conclusion be arrived at which will allow for such a peace process to develop.” ENDS
