Ó Caoláin welcomes Supreme Court urgency
Sinn Féin Dáil leader Caoimhghin Ó Caoláin has today welcomed the Supreme Court’s signalled intention to expedite proceedings in the Government's Supreme Court appeal against High Court President Mr Justice Nicholas Kearns's ruling of last week on the Donegal South-West by-election which found in favour of Senator Pearse Doherty.
The Dáil leader said:
"I welcome the decision by the Supreme Court to have the Government's appeal placed for mention next week. Chief Justice Murray clearly intends to treat this case with the urgency that it deserves. The Government’s submission and Senator Doherty's response should be before the court before the month's end. I would like to reaffirm that it has been Senator Doherty's determined and courageous decision to confront the Government in the courts that has forced both the Government's hands and Fine Gael’s belated judicial action.
"Justice Kearns made it abundantly clear to the Fine Gael legal team today that he will not proceed with any other related case until the Supreme Court has ruled on the Government appeal. If the Government loses it will mean that any further action by Fine Gael with regard to the by-elections for Dublin South and Waterford will become redundant since, according to the Government, they will move the writs for both by-elections 'immediately'."
