Councillor Louise Dunne calls on Joan Burton to rectify informal insolvency loophole
Sinn Féin Councillor Louise Dunne this evening secured the support of her South Dublin County Council colleagues to write to the Minister for Social Protection calling on her to urgently rectify the legal loophole that allows for the reckless practice of informal insolvency by rogue employers leaving workers unable to access their statutory entitlements.
Speaking after the council meeting Cllr. Dunne said:
“This government has failed to put in place the necessary legislative protection to ensure workers are not left high and dry in the event of informal insolvencies, despite a number of high profile cases where workers have had to engage in sit-ins to access their statutory entitlements.
“In January 2011 all functions assigned to the Jobs Minister under the Protection of Employees (Employers' Insolvency) Acts 1984 to 2006 were transferred to the Minister for Social Protection.
“Labour Minister Joan Burton TD could and should have amended this legislation to protect workers where informal insolvencies occur.
“Sinn Féin’s Jobs Spokesperson Peadar Tóibín will present draft legislation to the Minister for Social Protection and will urge Joan Burton to quickly and constructively engage with the proposed Bill.
