Government perpetuating Direct Provision misery – Senator Ó Clochartaigh

Sinn Féin Senator Trevor Ó Clochartaigh has accused Minister Aodhán Ó Ríordáin of denying immigrants fundamental human rights, as the Government railroaded through flawed legislation in the Seanad yesterday.

Speaking after the government used their majority to guillotine debate on the International Protection Bill, he said:  

‘The Minister has reneged on promises made to implement all the recommendations of the Working Group on Improvements to the Protection Process, including Direct Provision and Supports to Asylum Seekers, which he set up and which his Department signed off fully on.

“The bill does introduce a single procedure for people wishing to remain in Ireland and for asylum seekers, which Sinn Féin welcomes, but there are also serious gaps and omissions in it which the Minister refused to take on board. Many of them should be part of this bill and they aren’t.

“The government parties are aware of these shortcomings as NGO’s such as the Irish Refugee Council, NASC, Doras Luimí, Spirasi, UNHCR, the Childrens Rights Alliance and others have been very vocal in their criticism of the legislation.

“The government has failed to deliver on a substantial number of recommendations which would bring Ireland in line with all other EU countries and International best practice such as the Right to Work and Right to Education principles.

“We are also very concerned that recommendations in relation to Independent Oversight, Child Protection and legal safeguards for individual applicants made by many NGO’s, Ombudsmen, parliamentary committees and others have been totally disregarded by the Government.

“To their shame the government rammed this bill through and have put their own political interests before the protection and dignity of vulnerable migrants.’

Tá sé curtha i leith an Aire Aodhán Ó Ríordáin ag Seanadóir Shinn Féin, Trevor Ó Clochartaigh, go bhfuil sé ag ceilt cearta bunúsacha daonna  ar inimircigh agus an rialtas ag brú reachtaíocht fabhtach tríd an tSeanad inné.  

Ag labhairt dó i ndiaidh don rialtas an móramh atá acu sa Seanad a úsáid chun deire a chur le díospóireacht ar an mBille um Chosaint Idirnáisiúnta, deir sé:

‘Tá an tAire tar éis loic ar na geallúintí a thug sé go gcuirfí na moltaí atá sa tuairisc ón nGrúpa Oibre ar Leasuithe ar an gCóras Cosanta, an Soláthar Díreach agus Tacaíochtaí do Lucht Iarrtha Tearmann i bhfeidhm ina iomláine, tuairisc ar bhunaigh a Roinn féin agus ar ghlac siad lena gcuid moltaí ina iomláine.

“Tugann an bhille isteach córas nua aon iarratais dóibh siúd a bhíonn ar thóir tearmann in Éirinn agus fáiltíonn Sinn Féin roimhe sin, ach tá bearnaí suntasacha agus easnaimh mhóra eile inti nach raibh an tAire sásta aghaidh a thabhairt orthu. Ba chóir do chuid mhaith acu a bheith clúdaithe sa bhille agus níl.

“Tá páirtithe an rialtais ar an eolas go maith faoi na laigeachtaí sa reachtaíocht seo, mar go bhfuil siad curtha in iúl dóibh go soiléir ag eagrais neamhrialtasacha go leor, ina measc Comhairle na dTeifeach in Éireann, NASC, Doras Luimí, Spirasi, UNHCR agus Cónaidhm Cearta na Leanaí.

“Tá teipthe ar an rialtas díriú ar ualach mhór moltaí a chuirfeadh Éireann ar chomhchéim le tíortha an AE ar fad agus le cleachtais d’ardchaighdeán idirnáisiúnta ar nós prionsabail um Chearta Oibre agus Cearta Oideachais.

“Tá an-imní orainn chomh maith go bhfuil neamhaird iomlán déanta de mholtaí maidir le maoirsiú neamhspleách, cosaint leanaí, cosaintí dlíthiúla do dhaoine aonair agus eile atá déanta ag na h-eagrais neamhrialtasacha, Fir an Phobail, comhchoistí Oireachtais agus dreamanna nach iad.

“Is mór an náire don rialtas gur chur siad an oiread teannadh faoin reachtaíocht seo tríd Thithe an Oireachtais agus gurb é a leas polaitiúil féin seachas cearta agus dínit na dteifigh leochaileacha a bhí ag déanamh imní dhíobh.”
