Setanta claimants are innocent victims of a bigger battle - Pearse Doherty TD
Sinn Féin Finance spokesperson Pearse Doherty TD has said the claimants awaiting compensation through the Setanta liquidation process are innocent victims of a bigger battle.
Speaking in the Dáil today Teachta Doherty said the priority should be for all claimants to be compensated in full as soon as possible.
Deputy Doherty said:
“It is clear the thousands of claimants are innocent victims of a bigger legal battle. The Minister for Finance initially told me nearly two years ago that the Motor Insurers’ Bureau of Ireland would be paying out.
“They then got legal advice saying the Insurance Compensation Fund (ICF) should pay out. The Attorney General backed up this view. However the Law Society brought it to my attention that they did not agree. They subsequently took a case and won both in the High Court and in the Court of Appeal.
“This farce has been rumbling on too long and I hope the Supreme Court will soon make its decision. In the meantime I support the call for the ICF to step in and pay the liquidator so that claimants will receive compensation.
“Tonight’s motion unfortunately doesn’t deal with the fact that the ICF is limited to paying out 65% of a claim or a cap of €825,000 whichever is lower. I have been calling for some time for this cap to be removed in legislation so that the ICF can fully compensate the Setanta claimants.”
