Department of Justice must publish Disclosures Tribunal discovery orders – Donnchadh Ó Laoghaire TD

6 December, 2017 - by Donnchadh Ó Laoghaire TD

Sinn Féin Justice Spokesperson Donnchadh Ó Laoghaire has this afternoon called on the Department of Justice to publish the Discovery Orders of the Disclosures Tribunal.

Speaking today following the Justice Committee meeting with key Department of Justice Officials today, Teachta Ó Laoghaire said;

“In the interest of public confidence and transparency I think it is of the utmost importance that the Department of Justice publishes the discovery orders made by Justice Charleton.

“The Department officials this morning came before the Oireachtas Committee on Justice and question arose to what had been requested and what had been handed over to the tribunal.

"Indeed, incredibly, they struggled to inform us even broadly what was contained in the Discovery orders, despite relying so heavily upon them.

“It is hard to imagine that under the terms of reference, with a particular focus on Section H that the email thread on the 15th May, or the thread from the 4th of July, would not have emerged previously.

“Department officials this morning claimed they gave what they were asked for. Under Section H, of the terms of reference of the Tribunal in particular, these emails plainly are relevant, and should not have been withheld.

“Was it not for PQs the integrity and usefulness of the Tribunal would be jeopardised due to it not having the full information.

“The review being carried out by the Senior Counsel will not probe intent, or investigate the possibility of collusion or a cover-up, or deliberate non-disclosure, on the part of the Department, nor will the Tribunal.

“It is essential that this is considered by Justice Charleton as there is an enormous public interest in this issue.
